EU Sets Ground Breaking Rules For Artificial Intelligence Act

EU sets out the new Artificial Intelligence Act

In a landmark move, the European Union has reached a provisional agreement on the world’s first set of rules for Artificial Intelligence, known as the Artificial Intelligence Act. This agreement, achieved after intense negotiations, aims to ensure AI systems in the EU are safe, respect fundamental rights, and align with EU values, while also encouraging investment and innovation in AI across Europe.

Key Highlights of the AI Act

Risk-Based Approach

The AI Act introduces rules based on the potential harm AI can cause. Higher-risk AI faces stricter regulations.

Prohibitions and High-Risk AI

Certain AI practices, like cognitive behavioural manipulation and untargeted facial image scraping, are banned. High-risk AI systems will be subject to stringent requirements for EU market access.

Law Enforcement and AI

The Act allows law enforcement to use AI with safeguards, including in emergencies and for preventing serious crimes.

General Purpose AI Systems

New rules address AI systems with multiple uses, especially those with significant impact, requiring them to meet specific transparency obligations.

Governance and Enforcement

An AI Office within the EU Commission will oversee advanced AI models, supported by a scientific panel and an AI Board comprising member states’ representatives.

Penalties for Non-Compliance

Companies violating the AI Act could face substantial fines, with provisions for more proportionate fines for SMEs and startups.

Transparency and Fundamental Rights

High-risk AI systems must undergo a fundamental rights impact assessment. Public entities using such systems must register them in an EU database.

The Act includes measures like AI regulatory sandboxes to foster innovation in AI development.
